These Terms of Service ("Terms") govern your use of the PROOF web application (the "Service") operated by PROOF ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
PROOF is a podcast review analysis platform that collects publicly available review data from Apple Podcasts and applies statistical pattern analysis to identify anomalies, outliers, and trends. The Service provides free preview analysis and paid detailed reports.
2. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
You must be at least 18 years old to create an account and use the Service.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, or extract the source code or algorithms of the Service
- Use the Service to harass, defame, or intimidate podcast creators, reviewers, or any other individuals
- Scrape, crawl, or automated-access the Service beyond normal use without prior written consent
- Share, resell, or redistribute purchased reports or analysis data for commercial purposes without authorization
- Create multiple accounts to circumvent usage limits or abuse free features
- Interfere with or disrupt the integrity or performance of the Service
4. Purchased Reports
The Service offers detailed analysis reports for individual podcasts, available for purchase. All purchases are final. Due to the digital nature of the reports, refunds are not available once a report has been generated and delivered. Reports are licensed for your personal or internal business use only.
Report content, including pattern scores, statistical benchmarks, and analysis, is generated algorithmically based on publicly available data and should be considered informational, not definitive. We do not guarantee the accuracy of any individual analysis.
5. Data and Analysis Disclaimer
PROOF analyzes publicly available podcast review data from Apple Podcasts. Our analysis is based on statistical patterns and heuristics. Results are provided "as-is" for informational purposes only and should not be construed as:
- Definitive proof of fraudulent or inauthentic review activity
- An accusation against any podcast, creator, or reviewer
- Legal advice or evidence suitable for legal proceedings
- An endorsement or certification of any podcast's authenticity
Pattern scores reflect statistical likelihood relative to benchmark distributions. Elevated scores indicate deviation from typical patterns but do not confirm manipulation. Users are responsible for interpreting results in context.
6. Intellectual Property
The Service, including its design, code, analysis methodologies, brand assets, and content, is owned by PROOF and protected by applicable intellectual property laws. The PROOF name, logo, and mark are our trademarks. You may not use our trademarks without prior written consent.
Podcast names, artwork, and review content displayed in the Service are the property of their respective owners and are used for analysis purposes under fair use principles.
7. Third-Party Services
The Service relies on third-party platforms and services, including:
- Apple Podcasts: We access publicly available data. We are not affiliated with, endorsed by, or sponsored by Apple Inc. Apple, Apple Podcasts, and related marks are trademarks of Apple Inc.
- Stripe: Payment processing is handled by Stripe, Inc. Use of Stripe is subject to Stripe's Terms of Service.
- Google: Optional OAuth sign-in is provided by Google. Use is subject to Google's Terms of Service.
We are not responsible for the availability, accuracy, or policies of third-party services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROOF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ANALYSIS OR DATA WILL BE ACCURATE OR COMPLETE.
10. Indemnification
You agree to indemnify, defend, and hold harmless PROOF and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including limitation of liability, disclaimer, and indemnification) will survive.

12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
